Court ruling against Penn State in two hazing cases

Read this article this morning about recent court ruling against two Penn State fraternities. This could get interesting for FSL offices.

....and the dam begins to break. If the courts are this tough on these cases, wait till motions in the Beta case are heard--Katie bar the door!

From what I gather, this was on motions to dismiss where the standard to keep a claim alive is very low. This is a long process and isn't going to be binding on other jurisdictions. The plaintiffs are going to have a very difficult time proving liability here. I also see the issue is more that the R.A. making the proper report and the proper campus mental health services attempting to engage as more significant than the alleged hazing. Students can be depressed and suicidal for a variety of reasons, and that they were hazed may be one of many reasons. If we're going to open up the Pandora's Box to the extent that we're trying to impute liability to anyone who might be responsible for the mental health conditions leading to a suicide, then yeah, Katie bar the door.
