technically, paying $5.00 per hour plus tips in a coffee shop is kinda illegal, bud. you want to do everything by the book, fine. I just hope you don't run the store down to the ground and alienate the regular customers while you doing that.

I *think* that as long as the tips + $5 = min. wage, it's legal - but if they don't the employer has to make up the difference (on a day-to-day or weekly basis, depending on how payroll is done). At least, that's how it is for waitresses.
